Professional Experience

Ben Balding is an experienced litigator whose practice focuses on complex business disputes in federal and state courts. He has represented and counseled clients in a broad variety of matters, including breach of contract, business torts, shareholder and partnership disputes, intellectual property, insurance coverage, trade secrets, and securities claims.

Mr. Balding also completed the Los Angeles County Bar Association's Trial Advocacy Project ("TAP"). The TAP program allows attorneys, after extensive training and certification, to try misdemeanor cases on behalf of offices of local prosecutors. After certification, Mr. Balding served as sole trial counsel in three jury trials to verdict as a volunteer prosecutor for the Anaheim City Attorney's Office.

In 2013 and every year since, Mr. Balding has been recognized as a "Rising Star" by Super Lawyers and Los Angeles magazines.

Recent Matters

  • Representation of nation's highest-volume over-the-phone language services provider in complex trade secrets lawsuit.
  • Obtaining favorable settlement on behalf of individual lenders in a fraudulent hard money lending transaction.
  • Representation of inventor of advertising display process in patent infringement lawsuit asserted against several large corporate entities.
  • Defense of large insurance company in long-running environmental and contract dispute.
  • Obtaining reversal by California Court of Appeal in racial discrimination case after trial court dismissed all claims.
  • Defense of a former CEO of a major lending company in government enforcement action and in additional civil lawsuits brought by former investors and insurance companies.
  • Defense of a national fast-food chain in class action arbitration proceeding arising out of the Fair Labor Standards Act.
  • Obtaining dismissal with prejudice at the pleading stage (affirmed by the Seventh Circuit) on behalf of a domestic steel mill in fraud suit brought by investors of Thai steel mill alleging $1 billion in damages.
  • Representation of a whistleblower and numerous public agencies in a suit against a manufacturer of parts for public water systems.
  • Representation of a major television network in class action claim involving copyright infringement.
